How Lemon Laws Apply to Defective Kia Vehicles

14/09/2020

There is nothing more annoying than driving a car that is constantly having issues and needs repair on a regular basis. Kia, which is one of the fastest growing auto manufacturer in North America, is under scrutiny because some of its models have recurring problems that continuously need repair. If you have a Kia vehicle that has multiple problems, it could mean that your car is a lemon. The following is all you need to know about defected Kia vehicles and the Lemon law.

Is Your Kia a Lemon?

The following questions can help you determine if your vehicle is a lemon or not:

  • Is your vehicle having recurrent problems?
  • Have you taken your Kia vehicle to the manufacturer or licensed dealer for repeated repairs?
  • Did the problems with your vehicle begin under the warranty?

If your answer is “yes” to one or all of the above questions, you might be in possession of a lemon car implying that you are entitled to repair, replacement, or refund under the state laws.

How the Lemon Law Works

If you buy a vehicle and it has problems within the first few week for no apparent reason, your warranty will take care of the repairs. You only have to take it to the dealer and have it checked and repaired. If the problems persist after numerous attempts, then your car is a lemon and you are entitled to either a refund or a replacement.

The requirements and factors that determine whether your car is a lemon vary in different jurisdictions. The common lemon law requirements in California include:

  • Vehicle repairs should be restricted to an appropriate number of trials
  • Manufacturing companies should buyback, repair, or replace defective vehicles from consumers
  • Manufacturers should compensate damages caused the defects
  • Repair for defective vehicles should not take longer than 30 days

A Kia lemon law covers both used and new vehicles, as well as purchased or leased cars, provided the cars are still under the manufacturer’s warranty. The problems with most Kia lemon cars include:

  • Catastrophic engine failure
  • Intermittent loss of power
  • Engine stalling and overheating
  • Faulty emergency brakes
  • Problems shifting gears
  • Steering wheel pulling to one side while driving

Do You Need Help with You Kia Lemon Car?

Numerous Kia models have been reported to have many defects. The most affected models are Kia Optima, Kia Sorento, and Kia Sportage — manufactured between 2011 and 2019. California provides one of the country’s most comprehensive Lemon Laws, which covers consumers who have purchased or leased vehicles with a warranty in the state. If you own or lease one of the vehicles listed above and have
repaired it for engine related problems, it might be a lemon car.
