Clearing Up Workers Compensation Misconceptions

29/05/2024

If we hear the term “workers comp,” we probably feel like we understand the basics – if you get hurt on the job, you file for workers comp, you get time off to heal and hopefully a little extra something along with your salary to make it all easier. In an ideal world, sure, it would be that easy and that quick. Some people aren’t aware that they might need an attorney to help them navigate their way through workers comp, and if they do, they might be afraid to spend the money. Fear not – here are some things you should understand about Workers Compensation in California and Arizona.

Keep Records and File the Paperwork

Of course, consideration number one is your health and safety. If you are injured, you should be seen by the appropriate medical professional, whether that be a nurse at your place of work or at a hospital. Be sure you let your employer know that you’ve had an accident, and be sure they document it. To make sure all of your bases are covered, contact us to get your workers comp claim filed.

Know What is Covered Under Workers Comp

Provided your employer is properly insured and you can document your claim, many types of injuries are covered under workers compensation. Typically, the types of injuries that are considered the most urgent in terms of care are the ones that require the most hospital time, recovery, rehabilitation and coverage. Some of these types of injuries include:

  • Back, neck and spinal
    cord injuries
  • Broken or fractured bones
  • Muscle and tendon injuries
  • Head injuries
  • Loss of limbs
  • Paralysis
  • Internal bleeding

Any of these should be taken seriously and deserve to be fought for in court.

How Does the System Work?

Businesses should be paying into the workers compensation system regularly, as a form of insurance. Once an injury has been proven, those funds pay out, according to the actual losses the injured person suffers. This system is in place to avoid a traditional civil trial in which coworkers or the employer itself are sued. Every worker who has been injured on the job should pursue workers compensation claims to avoid being on the line for the piling medical bills and to be compensated for their suffering, especially if the injury will have long-term effects on the injured person.

What Do Arizona and California Cover?

In terms of Workers Compensation, both California and Arizona consider compensation for the same types of losses. A loss is anything that results from your injury and that can be found to have a monetary value. Types of losses covered in Arizona and California include:

  • Pain and suffering
  • Future medical care or continued medical care
  • Medical bills
  • Lost wages resulting from your inability to work
full-time, or needing to take time off

This is why it is important to keep your documentation and make copies, and to secure legal representation to help you handle your complicated workers compensation claim.
